Chief Justice Roberts Is Dead Wrong About Auer Deference

Chief Justice Roberts is wrong to say that Justice Kagan's and Justice Gorsuch's positions on Auer deference are not far apart. He should realize they differ in kind. Kagan's version of Auer deference violates the Constitution in important ways that Gorsuch's lesser form of deference does not.
